I doubt BMW will offer a turbodiesel unless they can get their engine to meet EPA Tier 2 Bin 5 and CARB 2007 standards. And injecting urea gas into the exhaust stream to reduce NOx levels is something that the EPA is not too thrilled about.
Interestingly, if BMW can license Honda's new plasma-gas reactor technology that breaks down NOx, then they could make the engine 50-state US legal.

I, like others, think that the current BMW 5 series is nicer than this 2009 one. I think the current one looks much sleeker because of it raised belt line and looks really sporty, while this one does sport sportiness the rear end just kills the entire theme (09 model). The specs on the 09 are pretty good compared to the current generation.

keep in mind, these are not official or even leaked pics from BMW. these pictures are almost definately an artist's conception of what the 2009 5 series will look like. it's only 2006, and the 2009 5 series is at least two years away. BMW isn't going to have promotional-quality images already available at this stage. the car's design probably isn't even finalized yet.
