Yes. It's going from the Catalytic Converter BACK, so it's not actually modifying anything that handles your emissions and the "cleaning" of them. The only thing it modifies is flow, obviously, and sound/appearance. In California we don't have sound inspections so you'll be fine, but I believe if the exhaust is over 95dB it's considered illegaly - and I highly doubt your exhaust is that loud anyway, so I wouldn't worry about it.
You could theoretically cut the exhaust off after the catalytic convertor and it would still pass the smog sniffer, I doubt it'd pass inspection, but it'd pass the sniffer. So yes, it will pass.
