I have the same problem. Don't know what causes that. It's only sometimes though.

Auto-trannys have an interlock system. It's not supposed to let you shift out of Park unless you're stepping on the brake. Check whether that mechanism at the shift lever is adjusted properly?

(If the switch on the brake pedal was bad, it wouldn't let you out of park at all.)

Still, take apart the console so you can see the shifter & cable & interlocks. Maybe you can see something loose, sticky, out-of-place, or whatever??

Maybe the cable is getting dirty/stiff?

You'll want to rule out any simple problems with the lever before you go messing with the tranny itself.

hmm...cable sounds like something to look into...by console you mean center console correct?

Details are different for different years, but yeah - center console plus whatever has to get out of the way for you to see the shift lever mechanism & the shift cable.

Take the shifter apart...you'll find enough gunk in there to see why it gets sticky. When I got my TL shifter I couldn't believe the amount of gunk in it...it would actually stay in the +/- side of the sportshift gate because it was so nasty. I shudder to think of what was spilled on it.

When this happened in my 96 Accord, I took apart the center console to access the mechanisms. I found years of spilled drinks, milkshakes, crumbs, etc. I cleaned it all out with a tooth brush and then greased all the parts. Put the console back together and voila, shifter was smooth again.
