You're probably rubbing on the triangular plastic piece on the rear bumper. It's a common problem with 5th gens on rims that are larger than stock size. Once you cut that off it should be ok. However, you may want to check the offset of your rims. I'm just gonna take a guess that your offset may be a little high, if you're rubbing with those tires without being lowered at all. Stock offset is +55mm. I wouldn't risk running anything less than a +45mm offset on aftermarket rims. Also there's only one company that makes 225-40-17 tires and that's Nitto. The next closest to stock tire size you can buy is 215-40-17.
