The person who did the keying doesn't stand to gain anything by saying there was underage drinking involved--they were drunk too right?

Go ahead and file that lawsuit (after talking to an actual lawyer first obviously). It's not like they're going breathalyze all the people who were at the party a month after the fact when it goes to small claims court or something.
