Default Insurance question

So I got in a minor accident a little bit ago and I've never been in one, at first I wasn't gonna call the insurance company, but the guy that hit me did and now he is saying I pulled out in front of him. What happened is he merged into my land and hit me on the rear right quarter panel. Now he has one witness, but I have two...I don't like the idea I could be put at fault, is there any way he'll turn it around on me?

Call your agent, don't talk directly to the other guy.

Cause I wasn't even gonna go to the insurance with it, now this guy wants to and he has a totally different story. Can insurance companies make it no ones fault because it's a he says she says story?

Normally, if the damage is on the rear of your car, odds are they'll put the guy at fault. But since theres no police report, it gets tricky. Call your agent ASAP. If youre ever in an accident thats somebody elses fault ALWAYS call the popo. You don't have to make a claim if you don't want to, but if you choose to do so, you'll be a lot better off with a report to back you up.

Always get a police report no matter what, you'll have that garuntee IF something like this were to happen, but since you didn't.. it's a bit hairy. The insurance companies won't just drop it because it's he says she says, but then now that I am thinking about it, I don't know if he has a valid case being that he didn't have a police report.
