Depending on what year civic you have, you could probably just take out the brake light (unless it's like mine and its all one piece)...
Then again, if you ever get a different spoiler w/o a brakelight.

ok, but my reason behind asking that question is that here in NY, I think I have yet to see a Civic that has tinted windows (whether it has a spoiler on it or not) that does not have a section on the back window where it is not tinted for the brake light. Therefore, because I have made such observations, I asked if there was any law about it. There are many unusual laws out there, and I didn't know if this was one of them.
