It's BYU's team, BYU's ethics code and most importantly, BYU's prerogative to boot Davies out.
No matter what you call it -- an honor code, a code of ethics, whatever -- the terms define a contract between BYU and the players.
Davies knew or should have known those terms when he signed.
He broke them.
It seems fit, then, to suffer the consequences.
BYU's Honor Code was created out of religious doctrine, but is a great "moral code of ethics" regardless of your religion or belief. There are students at BYU that are not LDS *gasp*. All are required to agree and adhere to the honor code.
