If you did something like brake checking the insurance companies (and later the law) would consider that fraud (they would view this as an accident you caused to wreck someone on purpose and would pin the "for financial gain" part of it on you as well).
but the other driver was drunk so that supercedes the brake check.

Insurance companies can fight it out but at the end the drunk guy shouldnt of been on the road.
