Default Engine drama!!! :madr:

Okay, so a buddy and I head to Jerrys Curb Service for a bite to eat, and while we are there, Rick (used to work for Jay tinting cars, now has own biz), Jay (used to own Tri County Customs), and their familys pull up in their fancy cars and stuff, which was cool. We are hangin out and talkin for over an hour about stuff, and then Rick turns to me and says.. so dude, Dave (current owner) told me your engine showed up today? and I replied yeah, I saw it this morning, and said they wanted my car in at 11am Tuesday to start tearing it apart. WELL, Rick gave me some inside news.. and here it is..

When I go down there tomorrow, Dave is going to refund me the labor charges and tell me to take the swap somewhere else, because apparently he cant find anyone to do the install (Dave told me Jay was gonna do it, but never asked Jay.. just assumed. Jay hates Dave). Rick also told me that Dave didnt order anything up until last week, when I started getting suspicious and asking for proof they ordered it and such, that is when he actually ordered it. So it turns out that when they "received" the wrong swap, that they were lying (I had no way of verifying this because I was in Texas).

Anyway.. what should I do? I will take the refund I get in a heartbeat, but should I cause a scene and try to make them pay to ship the swap back and tell them I want a full refund? Threaten with a lawsuit? BBB? Attorney General? Should I take the refund, take the swap, and when I move into my new home do it myself with a few friends in our garage?

Desperately in need of advice.. I personally want to make them eat shipping and get a full refund and go to court and try to shut them down, but the other part of me wants to take the refund and the swap and do it myself. I am leaning towards the latter because it would be good experiance plus I already have the swap ready for me to pick up...
