Go ahead and erase the hard drive...computer forensics is a booming business and not much can stop it from gaining data off of your drive even with a format.
This is true. But still its not proof - all a defendant has to provide is reasonable doubt.
You could burn the harddrive, put it in a box full of magnets and then spray it full of bleach.
