so wouldn't that mean that he isn't court free?

Target will have to file a claim with their local county courts ( small claims ) and then a subpoena will be sent to his house via certified mail or something like that. ( A courier service with proof of delivery ) Now if he defaults on the letter target is sending him then they could proceed further with a suit.

I would speak to an attorney so that way I wouldnt have to pay that fee. Or at least a reduced fee.
