its not really about making an injury claim as much as it is avoiding a wreck and hitting a curb, which would screw up your car just as much had you taken the hit.
I mean, of course I'd want to avoid a wreck, too. but between either minor fender damage by hitting the idiot driver or potencially breaking a couple rims/axles/control arms by hitting a curb, I'd take the hit and claim under their insurance all day long.

the first major wreck I was in (I was riding shotgun in my friends bronco II), instead of rear-ending a van doing 50mph, my friend swerved to the right to avoid the van. Good move, but unfortunatly, it ran us right into a 4'x4' metal utility pole (which don't give to force, making the impact that much harder). He would have been better off hitting the van.....
