I met with my attorney Monday afternoon and here's the deal: I can sue, but I need to be able to prove that they knew about the pothole before the damage occured. There is no way I could prove that, but let's say I did and I take them to court and win the case. Texas legislation has not approved any funds for pothole damage so even if I win the case, I wouldn't get a settlement! Can you believe that s#it?! The only other chance I have is if that part of the road is maintained by contractors, I can go thru their insurance. Right now, the wheel and the custom paint is costing me $320.00. I think Honda charges $70.00 for a wheel alignment and God only knows if there is any suspension or front end damage, but my insurance covers it all, minus my $250.00 deductable. But TXDOT is ultimately responsible and should fess up. I guess this is what they mean when they say "you can't fight city hall". If you come to Texas, keep your eyes open for craters, Y'all.
