My condolence to you and your entire family. May your uncle "Rest in Peace". Do not for one second, second guess your decision. People under the influence, tend to gravitate toward light. So, any direction you would have went, he would have followed. You could not have avoided the collision. I do not call it an accident, because the jackass could have made the decision to stay sober.
Head on collisions are horrible and usually result in total loss of life. We can say your lucky, but any loss of a loved one makes that hard to see. You helped your uncle regain consiousness and he knew that. You did a wonderful thing in helping him have a fighting chance at survival. Without your actions, he would have most likely died in the car, without regaining consiousness. You did a wonderful thing and your actions were spot on. Your uncle loved you for your help and the moments you gave him. Remember that, always.
Now the "F"ed up part. Even though the jackass made a consious decision to take drugs and drive, knowing he could possibly hurt or kill someone, he will get vehiclar manslaughter or second degree murder at the most. They will never charge him with 1st degree murder w/ extenuating circumstances, which he deserves. The guy deserves "Life without parole" at the minimum. We all see the commercials and hear the stories, so we all know in the back of our minds, if we drive under the influence, someone could get killed. He killed someones loved one and in my opinon, he did it willfully. If i sat on the jury, I would not have a hard time giving the guy the death penalty. For the hurt, the tears, and the trauma he caused, he could never be sorry enough.
Force the D.A. to hunt for the highest penalty possible. If we as a society push for the highest penalty everytime, it will be easier to win and raise the level of prosecution. Fight hard Richard, fight for your uncle.
Love your family and know that every day is a gift. Realize that when we wake up in the morning, we are having the best day of our lives, because we are alive to make changes.
Richard, I dont pray much, but I will say a prayer for you and your entire family.
