Technically it is not child pornography unless the minor is involved in a sexual or obscene act of some kind. Even if they are nude, it can still be legal. It is perfectly legal to take pictures of an 'art' nature. You can find many many sites on the internet which display these pictures.
Girl can cry all she wants, but that is totally legal.
What's messed up about that is, she can be nude and it can be considered art, but pictures of a young girl fully clothed in "suggestive" positions, (i.e. bending over, spread legs), can be considered child pornography by the court
