I do think that in some ways it is unfair to automakers who don't have hybrids that meet these requirements, b/c it is in effect favoring a very narrow range of vehicles.
There is also a tax rebate for gas guzzlers over a certain number of pounds, in which cars like the Suburban, H2, or other SUVs sold.
