Ask your dad if he has the policy declaration for the homeowners. Read through it and look for any language that may be relevant to this accident. If you scan in the policy and email it to me, I'll look through it for you. In situations like this, if you make yourself a big pain in the ass to the insurance company and continually write letters, they usually will buckle and settle with you. Also, the other quickest way to get them to bitch out is to have a lawyer you know (read: free) write them a letter in lawyer speak outlining the strong points of your case on official letterhead. Most of the time they will kiss your ass so fast you can't believe it. This is because they are afraid of a potential punitive damage case related to their denial of a legitimate claim. I don't know if you care about that at this point or not, but I thought I'd just offer my .02
