As far as the deer arguement, that's different. Like I said, I saw in Ally McBeal once that pets are considered property. If your neigbors dog ran over to your yard, chewed up your garden hose and hurt your kid, you'd sue, right? If a wild deer did the same thing, you wouldn't sue, right? see how that deer argument makes NO sense?
if the neighbors dog did that, i'd tell the owner to keep his dog restrained, and tell him to pay for my hose. because i had NOTHING to do with the dog coming over and chewing it, and i might look at the fence i have and try to make it dog-proof. if a wild deer hurt my kid, i'd shoot em. these are all examples where i did nothing to provoke the situation.
i'll state it clearly now:
you got happy about your intake, and decided to be overzealous on the road, causing you not to see the cat. you HIT it, it didnt come up to your car and hit it.
