Why hold them and not give them trials, place them in limbo status because you don't feel like trying them? Try them for war crimes and be done with it. Holding people for no good reasons for years at a time without cause or, technically, any legal standing is "un-American". Now if they had a reason I don't have a problem but this time I agree with Jesse, if they are involved let them burn, if not then stop ruining someone's life just because you "aren't sure."

 

Uhh can't put them on US soil because of some world court thing or something. I remember reading something about jurisdiction issues on our soil and if they touch down here they are privy to US laws and rights which could end up working for them to our disadvantage in legal matters.

 

I thought it was more like ship them off to foreign bases to have them tried then imprisoned in the Federal prisons after. I don't recall either.
