Bought a new car..dealer forgot to collect down payment.
I bought a new car a few days ago. I went to the dealer and agreed to put down $2000.
After all the paper work was completed I took the car home and then realized I still had the money in my pocket. I got a loan on the car and the receipt says I paid the dealer $2000 down. I have all the paper work as if I paid the dealer the money but the dealer forgot to collect.
Today I received a voice mail about the mistake and that they want the money.
Legally wise, who wins this case if I don't pay up? I have paper work as if I paid.
I know most you guys are going to say just pay them the money but for arguments sake. Who would win?

Do you want to spend $2000 in court to find out? I strongly doubt that a judge would dismiss the dealer's claim on the grounds of a clerical error.

If you have all the paperwork saying you paid then I bet if you went to court and said you paid then the judge would have no choice but to side with you. I am not a lawyer tho...that is just what I think.

Add to that, they no doubt would take this to court which means you would be willing to lie under oath.
I vote corrupt ethics and morals and now that you have made this thread their lawyer can find proof of perjury through some creative google-fu...even after you delete the thread thanks to cached pages showing in searches.
Pay your damn bills, it's gonna cost you a hell of a lot more to try and not pay it than to just pony up the agreed amount.
